Al Mezan Center for Human Rights launches a campaign on the implementation of judicial decisions


On 25 April 2004, Al Mezan Center for Human Rights organized a workshop on the implementation of judicial decisions.
Many PLC members, law experts, journalists, and civil society activists attended the workshop.
In his opening presentation, Mr.
Issam Younis, Director of Al Mezan Center emphasized the importance of implementing judicial decisions and respecting the rule of law and remarked that civil society also has responsibility to ensure the implementation of court decisions.
Jamil Sarhan, Coordinator of the Legal Unit of the Center, pointed out that the implementation of judicial decisions is an obligation set forth in the Palestinian Basic Law and that any incompliance with such decisions should therefore be treated as a criminal act.
Accordingly, non implementation of court decisions contradicts Palestinian law that states that any party or entity preventing the implementation of judicial decisions should be punished by dismissal and imprisonment in case he is a public official.
Kamal Sharafi, PLC member, reiterated that implementing judicial decisions is a national duty and that the executive authorities are responsible for their implementation.
He added that preventing the implementation of judicial decisions is unlawful and cannot be tolerated where stability, strengthening of the judicial system and respect of rule of law are required.
For this reason, Mr.
Sharafi ensured that the PLC will take all possible measures to ensure the implementation of such decisions.
It is worthwhile mentioning that following a case taken to court by Al-Mezan, the PLC has already demanded and undertaken the necessary procedures to ensure that the Palestinian Monetary Fund implements the decision taken by the Palestinian High Court of Justice to lift the ban imposed on the assets of non-profit charitable organizations.
The participants delivered many statements emphasizing the need for PNA public authorities to take the necessary steps to ensure the respect of courts decisions.
Failure to do so results in a violation of basic rights of Palestinian citizens.
At the end of the workshop, Mr.
Younis announced the launching by the Center of a campaign on implementation of judicial decisions to ensure the rule of law.
Further steps of this campaign are to be carried out in the near future and will be announced shortly.
